Welcome to The iPhone Guy Buyback Program (“Company,” “we,” “our,” or “us”). By submitting a device, requesting a quote, or using our services, you agree to the following Terms and Conditions.


1. Agreement to Terms

By using our website or submitting a device for buyback, you agree to be bound by these Terms and Conditions.

If you do not agree, do not use our services.


2. Eligibility

To use our services, you must:

  • Be at least 18 years old

  • Be the legal owner of the device

  • Have full authority to sell the device


3. Device Ownership & Legal Responsibility

By submitting a device, you represent and warrant that:

  • You are the legal owner of the device

  • The device is not lost, stolen, or involved in fraud

  • The device is not financed, leased, or under contract

  • The device is authentic and not counterfeit or a replica device

  • You have full legal authority to sell the device

We reserve the right to:

  • Refuse any device

  • Withhold payment if ownership is in question

  • Cancel transactions suspected of fraud

  • Report suspicious activity to law enforcement


4. Device Condition & Inspection

All quotes are estimates based on the information you provide and are not guaranteed.

By submitting your device, you acknowledge and agree that:

  • The condition you provide must be accurate and complete

  • Devices will undergo a full inspection upon receipt

  • Any undisclosed issues (including internal damage, water damage, aftermarket parts, or functional defects) may result in a revised offer

We reserve the sole right to determine the device’s condition upon inspection.


5. Revised Offers & Customer Approval

If the actual condition of the device differs from what was submitted:

  • A revised offer will be provided

  • You may accept or decline the revised offer

No transaction will be completed without your explicit approval.

Approval may be provided via:

  • Text message

  • Email

  • Written confirmation

If you decline the revised offer:

  • Return shipping will be provided after payment of a return shipping invoice, or

  • You may accept the revised offer

Failure to respond within the stated timeframe may result in the device being treated as declined and subject to our abandoned device policy.


6. Payment Terms

Payments are issued only after:

  • Inspection is complete

  • Final offer is accepted

Payment methods may include check, store credit, or electronic payment.

We are not responsible for delays caused by third-party payment providers.


7. Shipping, Risk of Loss & Insurance

If you ship a device to us:

  • You are solely responsible for securely packaging the device

  • You are responsible for ensuring the device arrives safely

We may provide a prepaid shipping label for convenience.
Providing a shipping label does not transfer risk of loss to us.

Risk of Loss

  • Risk of loss remains with you until the device is physically received and accepted by us

Insurance Responsibility

  • Shipping insurance is not included unless explicitly stated

  • You are responsible for requesting and purchasing shipping insurance if desired

  • If you choose not to insure your shipment, you accept full responsibility for any loss or damage

We are not responsible for:

  • Lost packages

  • Stolen shipments

  • Carrier delays

  • Damage during transit

Recommendation

We strongly recommend:

  • Using insured shipping

  • Retaining your drop-off receipt and tracking number


8. Data Removal & Account Responsibility

You are solely responsible for:

  • Removing all personal data

  • Logging out of all accounts (including iCloud, Google, and any security locks)

Devices that are locked or not reset may be rejected or repriced.

We are not responsible for any personal data remaining on devices.


9. Refused or Ineligible Devices

We reserve the right to refuse any device, including but not limited to devices that are:

  • Reported lost or stolen

  • Locked or activation restricted

  • Financed, leased, or unpaid

  • Counterfeit, replica, or non-authentic devices

  • Significantly misrepresented in condition

If a device is determined to be ineligible:

  • Return shipping will be provided after payment of a return shipping invoice, or

  • The device may be handled in accordance with applicable laws


10. Abandoned Devices

If a device is:

  • Declined

  • Ineligible

  • Or no response is received

within 14 days of the date we send notice (via the email address or phone number you provided), the device will be considered abandoned.

We reserve the right to:

  • Recycle

  • Resell

  • Dispose of the device

without further liability or compensation.


11. Device Condition Documentation

You acknowledge and agree that:

  • We may document device condition through photos, video, and diagnostic testing upon receipt

  • This documentation may be used to verify condition and resolve disputes

  • Our records of device condition shall be considered accurate evidence


12. Inspection Authorization

By submitting your device, you authorize us to:

  • Inspect, test, and evaluate the device

  • Perform standard diagnostic procedures

We are not responsible for:

  • Pre-existing issues

  • Issues that become apparent during normal testing


13. Device Functionality Requirement

Devices must be able to power on and be testable unless otherwise disclosed.

If a device cannot be tested or has undisclosed issues, the offer may be adjusted.


14. Account & Management Locks

Devices that are:

  • iCloud locked

  • Google locked

  • MDM locked

  • Carrier blacklisted

may be rejected or repriced.


15. Non-Original or Modified Devices

Devices containing aftermarket parts, third-party repairs, or internal modifications may receive a reduced offer.


16. Liquid Damage

Devices with any signs of liquid exposure or corrosion may be repriced regardless of reported condition.


17. Missing Components

Devices missing components (including cameras, Face ID, buttons, or internal parts) may receive a reduced offer.


18. Processing Time

Processing times may vary based on volume.

We are not responsible for delays caused by carriers, payment providers, or high volume.


19. Transfer of Ownership

Upon acceptance of payment:

  • Ownership transfers fully to us

  • You relinquish all rights to the device


20. Payment Disputes & Chargebacks

By accepting payment, you agree:

  • The transaction is final

  • You will not initiate a dispute without contacting us first

If a chargeback occurs:

  • We may pursue recovery or legal action

  • You may be responsible for associated costs


21. Limitation of Liability

To the fullest extent permitted by law:

We are not liable for:

  • Loss of data

  • Shipping-related issues

  • Indirect or consequential damages

Our liability shall not exceed the amount paid for the device.


22. Quote Expiration & Market Changes

Quotes are:

  • Non-binding

  • Valid for 14 days

Devices received after that may be repriced based on market conditions.


23. Fraud Prevention

We may:

  • Verify IMEI/serial

  • Cancel suspicious transactions

  • Withhold payment

We may cooperate with law enforcement.


24. Communication

You agree:

  • Messages sent to your provided email/phone are valid notice

  • You are responsible for monitoring communication


25. Entire Agreement

These Terms constitute the entire agreement and supersede prior communications.


26. Independent Relationship

Nothing creates a partnership or agency relationship.


27. Right to Refuse Service

We reserve the right to refuse service or cancel transactions at our discretion.


28. No Obligation to Repair

We are not required to return a device in its original condition after inspection.


29. Good Faith

Both parties agree to act in good faith.


30. Force Majeure

We are not liable for events beyond our control.


31. Interpretation

These Terms shall not be interpreted against the drafting party.


32. Severability

If any part is unenforceable, the rest remains valid.


33. Governing Law

These Terms are governed by Oregon law.

All disputes shall be resolved in Deschutes County, Oregon.
You waive other jurisdictions and class actions.


34. Modifications

We may update these Terms at any time.
